Welcome to Target Reach Solutions, LLC, d/b/a, The Westford Select. These Terms & Conditions ("Terms") govern your use of our services, which include the creation and publishing of advertisements on shared, co-op style postcards that are distributed to households and businesses via the USPS. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Acceptance of Terms

By using our services, including submitting advertisements for publication, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must refrain from using our services.

2. Changes to Terms

We reserve the right to modify, update, or revise these Terms at any time. Any changes will take effect immediately upon posting on this page, and the “Effective Date” at the top will be updated accordingly. We encourage you to review these Terms periodically for any changes.

3. Services Provided

The Westford Select provides advertising services by creating and publishing advertisements for businesses on a shared, co-op-style postcard. The postcards are mailed to approximately 10,000 homes via the USPS (United States Postal Service). Our services include:

Designing Ads: We can create customized ads for your business.
Using Provided Ads: If you provide your own advertisement(s), we will publish them as submitted on the postcard.
Shared Postcard Distribution: Your ad will be part of a shared postcard that will be distributed to households within the specified geographic area (approximately 10,000 homes).

4. License to Use Advertisements for Marketing

Grant of License: By submitting advertisements to us (whether created by you or provided by you), you grant The Westford Select a royalty-free, non-exclusive, perpetual license to use, display, and share the advertisements in our promotional materials. This includes, but is not limited to, showcasing your ad content on our Facebook pages and Facebook ads, Google ads, social media group posts, our website and blog, email newsletters, promotional emails and promotional materials. The use of your ad content is strictly for the purpose of promoting our business and showcasing the work we have done for you, as well as marketing our services to other businesses and potential clients.

Self-Promotion: We may display your ad content in case studies, portfolios, and other marketing materials, such as online advertisements or email campaigns. By submitting your ad to us, you agree that we may use your ad to promote our business and services.

5. Payment Terms

Fees: You agree to pay the fees for the ad placement and any additional services provided. The cost for each ad will be determined based on the size of the ad and any special design or distribution requirements.

Payment Schedule: All invoices must be paid in full according to the payment dates specified in the invoice. If payment is not received on time, we reserve the right to suspend or withhold services, including the distribution of your ad.

6. Publication & Mailing

The publication and mailing of The Westford Select are at the sole discretion of our team and are dependent on the timely sale of available advertising space. While we make every effort to adhere to the projected mailing schedule, we cannot guarantee specific publication or delivery dates. Timing may vary based on market conditions and ad space availability.

7. Advertiser Responsibility

Ad Content: You are solely responsible for ensuring that the advertisements you provide do not violate any laws, regulations, or third-party rights, including but not limited to intellectual property rights, trademarks, and copyrights.

Approval: We will send you a proof of your advertisement for approval before printing and distributing it. You are solely responsible for reviewing and approving the proof within 24 hours of receipt. Once approved, your ad will be printed and included in the next postcard distribution.

8. Privacy and Data Collection

9. Disclaimers

No Guarantee of Success: While we strive to create high-quality ads and distribute them effectively, we do not guarantee specific outcomes, such as increased sales or business leads.

Content Rejection: We reserve the right to reject any advertisement that we believe violates applicable laws, is offensive, or is not suitable for publication on our postcards.

Limitation of Liability: To the fullest extent permitted by law, The Westford Select shall not be liable for any damages arising from the use of the Site or services, including but not limited to direct, indirect, incidental, or consequential damages, lost profits, or business interruption.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Westford Select, its officers, employees, agents, and contractors from any and all claims, liabilities, losses, damages, and expenses (including legal fees) arising from your use of the services, your submission of ads, or any violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to our services if you fail to comply with these Terms, fail to make payments, or engage in activities that we deem to be harmful or unlawful.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of New Hampshire, United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Rockingham County, NH to resolve any disputes.

13. Miscellaneous

14. No Refunds

We do not offer refunds. If you cancel or change your ad after the approval process or the printing of postcards, you will be responsible for any costs incurred by The Westford Select related to that ad.
